AN ACT TO AUTHORIZE THE DEDUCTION OF DUES FROM THE SALARIES OF STATE SERVICE OR NON-STATE SERVICE EMPLOYEES UPON WRITTEN AUTHORIZATION OF THE EMPLOYEE; TO AMEND SECTION 37-9-49, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE DEDUCTION OF DUES FROM THE SALARIES OF CERTIFICATED SCHOOL EMPLOYEES; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. It shall be lawful for the administrative head of any state agency to deduct or permit to be deducted from the salary of any state service or non-state service employee any dues payable to any organization or association upon written authorization from the employee involved.

SECTION 2. Section 37-9-49, Mississippi Code of 1972, is amended as follows:

37-9-49. It shall be lawful for the superintendent of schools * * * to deduct or permit to be deducted from the salary of any superintendent, * * * principal or licensed employee any dues, fines or penalties payable or alleged to be payable because of the membership of such superintendent, * * * principal or licensed employee in any organization or association, with the written authorization of such employee involved. * * * Dues or premiums in health associations or corporations and tax sheltered annuity deductions authorized by the United States Internal Revenue Code may be deducted upon written authorization from the superintendent, * * * principal or licensed employee involved. * * *

SECTION 3. This act shall take effect and be in force from and after July 1, 1999.
